CHAPTER 1. PURPOSE OF THE PRIVACY POLICY

The purpose of the Privacy Policy is to define the actions taken by Prouvé regarding the protection of Users' personal data, in particular the data collected via the Prouvé Website available at www.prouve.com or via electronic mail.

The Privacy Policy explains how we take care of your personal data, on what grounds we process it, and what rights you have.

The term “GDPR” means Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC.

CHAPTER 3. METHOD OF PROCESSING PERSONAL DATA

Prouvé processes personal data in accordance with applicable laws, in particular in accordance with the GDPR.

We respect your privacy – all personal data is treated as confidential and is processed only for strictly defined purposes, in accordance with implemented organizational procedures and technical safeguards.

 

CHAPTER 4. TYPES AND PURPOSES OF PERSONAL DATA PROCESSING

Your personal data may be processed for the following purposes:

1) Communication and handling inquiries

If you contact Prouvé (via the contact form, e-mail, phone), we process the data necessary to provide a reply, such as: first name, last name, e-mail address, phone number, and any content of the inquiry or attached documents.

2) Registering an account in the online store

To create an account in the Service we process the following data: first name, last name, e-mail address, password (encrypted), phone number (optional), delivery address and billing address.

3) Placing and fulfilling orders

When placing an order we process data necessary for the performance of the sales contract, including: first name, last name, delivery address, e-mail address, phone number, payment details and order specifics (products, quantities, values, delivery method).

4) Handling returns, complaints and claims

In the case of a product return or filing a complaint, we process the data necessary to consider and document them, in accordance with applicable regulations.

5) Direct marketing and commercial information

With your consent, we may process contact details (e-mail address, phone number) to send a newsletter, information about new products, promotions, special offers or satisfaction surveys.

 

CHAPTER 5. LEGAL BASIS FOR DATA PROCESSING

The legal basis for Prouvé processing your personal data may be:

1)       Art. 6(1)(a) GDPR - when processing is based on your consent (e.g. receiving the newsletter, publishing reviews),

2)       Art. 6(1)(b) GDPR - when processing is necessary for the performance of a contract to which you are a party (e.g. order fulfillment),

3)       Art. 6(1)(c) GDPR - when processing is necessary to comply with a legal obligation incumbent on the controller (e.g. storing invoices, handling complaints),

4)       Art. 6(1)(f) GDPR - when processing is necessary for purposes resulting from Prouvé's legitimate interests, such as:

a)        direct marketing,

b)       protection against claims and debt recovery,

c)        maintaining contact with the customer regarding placed orders or the user account.

If processing is based on consent – you have the right to withdraw it at any time, which does not affect the lawfulness of processing carried out before its withdrawal.

 

CHAPTER 6. DATA RETENTION PERIOD

Your personal data is stored only for the period necessary to achieve the purpose for which it was collected, namely:

1)       for the duration of the contract and the period for pursuing or defending against claims (up to a maximum of 6 years from the termination of the contract),

2)       for the period required by applicable law, in particular tax and accounting regulations (e.g. invoice data is stored for 5 years),

3)       until consent is withdrawn – in the case of processing based on consent (e.g. newsletter),

4)       until an objection is lodged – in the case of processing based on legitimate interest (e.g. direct marketing).

After the specified periods, the data are deleted or anonymized.

 

CHAPTER 7. DATA PROTECTION BY PROUVÉ

Prouvé makes every effort to protect the Website from unauthorized third-party access. We continuously monitor and improve technical and organizational measures used to ensure the secure processing of personal data.

In particular, we apply:

1)       data encryption (including an SSL certificate that protects the connection between your browser and our server),

2)       server and database security,

3)       access control to data – only authorized employees and associates have access,

4)       regular reviews and updates of security procedures.

The website www.prouve.com uses an SSL certificate that ensures the confidentiality of data transmitted electronically. Data is encrypted both when sent from your browser and when received by our servers.

Data processing is carried out in accordance with applicable laws, including the General Data Protection Regulation (GDPR).

 

CHAPTER 8. DATA SHARING

Prouvé does not sell, share or exchange its customers' personal data for marketing purposes with external entities.

However, we may disclose your personal data only to the extent necessary to fulfill an order or provide services, to categories of recipients such as:

1)       employees and associates of Prouvé – only those authorized to process data as part of their official duties,

2)       data processors acting on our behalf, such as:

a)        IT service providers (technical support for the store and systems),

b)       accounting and legal firms,

c)        logistics companies (e.g. carriers and courier operators),

d)       payment operators,

3)       public authorities, when we are legally obliged to do so (e.g. courts, law enforcement agencies, tax offices),

4)       banks, to the extent necessary to process payments and any refunds.

All entities to whom we entrust the processing of personal data operate under appropriate data processing agreements and are obliged to ensure an adequate level of data protection.

 

CHAPTER 9. TRANSFER OF DATA OUTSIDE THE EUROPEAN ECONOMIC AREA (EEA)?

It may happen that your personal data will be transferred outside the European Economic Area, e.g. in connection with our use of technology providers with registered offices or servers outside the EEA (e.g. cloud service providers).

In each such case we ensure an appropriate level of personal data protection in accordance with applicable law, in particular by:

  • using standard contractual clauses adopted by the European Commission,
  • transferring data to entities participating in the "Privacy Shield" program, if data are transferred to the USA (provided the applicable EU Commission decision recognizes that program as adequate),
  • other legally permitted safeguards.

 

CHAPTER 10. PERSONAL DATA PROFILING

Personal data may be processed in an automated manner, including profiling. Profiling may consist of analyzing your purchase history or viewed products in order to propose an offer best suited to your preferences.

However, we do not make decisions about you that produce legal effects or significantly affect your situation solely on the basis of automated processing of data, including profiling.

 

CHAPTER 11. RIGHTS REGARDING DATA PROCESSING

In connection with the processing of your personal data, you have the following rights:

1)       the right of access to personal data and to obtain a copy of them,

2)       the right to rectification (correction) of data if it is inaccurate or incomplete,

3)       the right to erase data (the "right to be forgotten"), if:

a)        you withdraw consent to data processing (if that was the basis for processing),

b)       the data are no longer necessary for the purposes for which they were collected,

c)        you object to processing for marketing purposes,

d)       the data are processed unlawfully,

4)       the right to restriction of processing, when:

a)        you contest the accuracy of the data – for the time of their verification,

b)       processing of data is unlawful, but you do not want them erased,

c)        the data are no longer needed, but are required by you for the establishment, exercise or defense of legal claims,

d)       you have lodged an objection – pending its consideration,

5)       the right to data portability, i.e. to receive the data in a machine-readable format (e.g. CSV) and to request their transmission to another data controller,

6)       the right to object to processing for the purposes of direct marketing – after lodging an objection we will stop processing the data for that purpose,

7)       the right to withdraw consent – if processing is based on your consent, you may withdraw it at any time without affecting the lawfulness of prior processing,

8)       the right to lodge a complaint with the supervisory authority, i.e. the President of the Personal Data Protection Office (ul. Stawki 2, 00-193 Warsaw), if you believe that the processing of your personal data violates the law.
